You can appeal against a refusal, a non determination or any conditions the council impose on your planning application. You can also appeal if the council refuses your Welwyn Garden City Estate Management Scheme application.

Please remember an appeal should only be a last resort. With only 36 per cent of planning appeals being won, look carefully at the reasons for refusal before you submit an appeal. In some cases you may be able to change the application to get consent. We are happy to discuss changes to a scheme through our pre-application advice process.


Planning Appeals

You can appeal at any time up to three months for a householder appeal (see below), or six months for any other appeal, from the date of the decision notice. Appeals can be complicated and expensive, especially if they involve a public inquiry, so we recommend that you get advice from an architect, planning consultant or qualified person before you start and particularly if you have not already done so.

Your appeal may be dealt with in one of four ways:

  • householder scheme (see below)
  • in writing
  • a hearing, or
  • by an inquiry.

In each case, the final decision is taken by the Secretary of State for the Department of Communities and Local Government or their representative.

Most people choose to appeal in writing as this generally means a quicker decision (see below for householder scheme).

Householder Appeal Service

The Householder Appeals Service process is simpler to understand, requires less form filling and relies mainly on information already sent to us. This reduces the time taken to submit the appeal and receive the decision.

A householder appeal is one against a refusal of planning permission (or the granting of permission subject to conditions to which the applicant objects) for works to a residential property or within its garden. It does not include:

  • a change of use or the erection of a dwelling;
  • appeals against "non-determination" where the council failed to issue a decision within the 8 weeks allowed; or
  • householder appeals which are accompanied by an appeal against the refusal of listed building consent or the service of an enforcement notice.

Normally it can take around 20 weeks to receive a decision from the day the appeal is received at the Planning Inspectorate. The Planning Inspectorate aims to decide 'Household' appeals in 12 weeks.

If your Estate Management Scheme application was refused you can submit an appeal to the council's Estate Estate Management Scheme Appeals.
